Privacy App Name may collect and use information about your usage of the App Name App, including certain types of information from and about your device. App Name may use this information, as long as it is in a form that does not personally identify you, to measure the use and performance of the App Name App. A Hackintosh is a type of non-Apple computer designed to run unauthorized versions of macOS. The name is a portmanteau of the words "hack" and Macintosh, the brand name of laptop and desktop computers made by Apple, Inc. Hackintosh laptops are sometimes referred to as Hackbooks. Certain basic representations and warranties should be given by each party to the other, such as the ability to enter into this agreement, the validity of the intellectual property, and a standard warranty disclaimer. These and others are listed below. You are permitted to load the software (for example a PC, laptop, mobile or tablet) under your control. You are responsible for ensuring your device meets the minimum requirements of the software. 1 See, for example, ProCD, Inc. Simply put, a EULA is a software license agreement. It is a grant of permission from the producer, publisher and/or distributor of a piece of software to you to do certain things, and more generally, governs your use of the piece of software being licensed to you, the end user. SolarWinds' Software and Documentation was developed exclusively at private expense and is a “commercial item” as defined in FAR 2.101, and any supplement is provided with no greater than RESTRICTED RIGHTS. Such Software and related items consist of “commercial computer software,” “commercial computer software documentation,” and commercial technical data as defined in the applicable acquisition regulations, including FAR 2.101 and FAR Part 12. Use, duplication, release, modification, transfer, or disclosure ("Use") of the Software and Documentation is restricted by this Agreement and in accordance with DFARS Section 227.7202 and FAR Section 12.212, and the Software and Documentation are licensed (i) only as commercial items; and (ii) with only the rights granted to commercial end users pursuant to this Agreement. Such Use is further restricted by FAR 52.227-14, 252.227-7015, or similar acquisition regulations, as applicable and amended.
