5.1 All Intellectual Property Rights over and in respect of the Asset are owned by Licensor. The Licensee does not acquire any rights of ownership in the Asset. A Hackintosh is a type of non-Apple computer designed to run unauthorized versions of macOS. The name is a portmanteau of the words "hack" and Macintosh, the brand name of laptop and desktop computers made by Apple, Inc. Hackintosh laptops are sometimes referred to as Hackbooks. Here, Microsoft has expressly nodded to fair use protections for reverse-engineering, but unless those reading the EULA are familiar with how "such activity" is "permitted by applicable law," they are likely to get the impression that most kinds of tinkering are unlawful. Any replacement Software will be warranted for the remainder of the original warranty period, or for thirty (30) days, whichever is longer. HID does not warrant that the Software will meet Licensee's requirements or will operate in combination with other software or hardware which may be selected for use by Licensee, or that the operation of the Software will be uninterrupted or error-free. SolarWinds' Software and Documentation was developed exclusively at private expense and is a “commercial item” as defined in FAR 2.101, and any supplement is provided with no greater than RESTRICTED RIGHTS. Such Software and related items consist of “commercial computer software,” “commercial computer software documentation,” and commercial technical data as defined in the applicable acquisition regulations, including FAR 2.101 and FAR Part 12. Use, duplication, release, modification, transfer, or disclosure ("Use") of the Software and Documentation is restricted by this Agreement and in accordance with DFARS Section 227.7202 and FAR Section 12.212, and the Software and Documentation are licensed (i) only as commercial items; and (ii) with only the rights granted to commercial end users pursuant to this Agreement. Such Use is further restricted by FAR 52.227-14, 252.227-7015, or similar acquisition regulations, as applicable and amended.
