Work for Hire Agreement Style 3

Work for Hire Agreement Style 3

Since a work does not become "for hire" unless the work falls within one of these nine narrow categories, a written work for hire agreement does not always result in a work becoming "for hire." For example, a novel, can never be a work for hire, because it doesn't fall into one of the nine categories of works eligible for work for hire status by non-employees. Only articles published in academic journals are still viewed as the faculty's own, but even that is changing on many campuses. Administrations are increasingly viewing the articles as work product, especially in fields in which there's a chance of making money from the articles' content and/or the faculty's investigations. Textbook publishers were one of the principal industries lobbying for the work for hire provisions in the 1976 law. The publishers wanted to more easily control the rights to all contributions to their textbooks. Only articles published in academic journals are still viewed as the faculty's own, but even that is changing on many campuses. Administrations are increasingly viewing the articles as work product, especially in fields in which there's a chance of making money from the articles' content and/or the faculty's investigations.
