From 1 January 2015, the Franchising Code of Conduct was updated. The changes include a requirement for parties to act in good faith, new fines and penalties for serious breaches of the Code and simplified disclosure requirements. A franchise is not a permanent arrangement, and a franchise agreement will specify the duration of the agreement. Each company has different rules regarding franchise agreements, so the duration of the franchise might be two years, five years, 10 years and so forth. In addition to explaining the duration of the franchise, the franchise agreement will provide information about the renewal of the agreement. Should the franchise operation prove successful, the company may choose to renew the franchise license with the franchisee, and the agreement will contain all the necessary information about if and when this may occur. Should the operation prove unsuccessful--if the franchisee breaks stated rules or fails in the business--the agreement will provide information about termination of the operation.
